The original exhibits and exhibitions upon which Exhibit Commons submissions are based have full copyright protection.
Exhibit Commons operates under a Creative Commons License. Submissions, whether generated by Liberty Science Center or by others, must adhere to the License, which allows use and public display by the Science Center, but which also allows creators to reserve whatever rights they desire to maintain. Please see the Creative Commons website for details on licensing.
Rights for Contracted Exhibits
The following applies to all exhibits that Liberty Science Center has contracted for design, production/programming and fabrication:
i. Designer/Producer/Fabricator, on behalf of itself and all its agents, subcontractors, and other contributors to the Work, hereby assigns and transfers all Intellectual Property Rights in and to the Work to the Owner (Liberty Science Center), its successors and assigns, absolutely and in perpetuity, throughout the world and for all purposes whatsoever. To confirm this assignment, and as a material and unwaivable condition to receiving final dispensation under this Agreement, Designer/Producer/Fabricator shall execute and deliver (and cause every one of its agents, subcontractors, and other contributors to the Work to execute and deliver) to Owner an Assignment of Copyright.
ii. Designer/Producer/Fabricator warrants and represents: that Owner shall own all right, title and interest in and to the Work throughout the World, including all Intellectual Property Rights; that Owner shall be free to use the Work throughout the World without any model releases, property releases, licenses, waivers or other permissions from third parties; that the Work shall not infringe on or violate the Intellectual Property Rights or other rights of any third parties anywhere in the World; that the Work shall not contain any libel, slander, blasphemy or other objectionable matter anywhere in the World; and that the Work shall not contain any matter that violates native or cultural rights anywhere in the World. Designer/Producer/Fabricator shall provide to Owner, or cause to be provided to Owner, written waivers of all moral rights (including, without limitation, all rights under 17 U.S.C. 106A and 113) and resale royalty rights in the Work that Designer/Producer/Fabricator or any third parties may have under present or future law, anywhere in the World, with respect to all uses of the Work.
iii. Notwithstanding the above, Designer/Producer/Fabricator’s intellectual property existing prior to the date of this Agreement (“Prior Art”), including trademarks, copyrighted materials, patents and trade secrets remain completely and solely the property of Designer/Producer/Fabricator. In the event Designer/Fabricator reveals such Prior Art or incorporates such Prior Art into Designer/Producer/Fabricator’s Exhibits or Work, Designer/Producer/Fabricator hereby grants to Owner a perpetual, world-wide, fully assignable, unconditional, but non-exclusive license to use and sublicense, and to authorize others to use and sublicense, such Prior Art for any and all purposes, without notice to or approval of Designer/Producer/Fabricator.
